Waad Society’s Statement on the High Administrative Court of Appeal’s Session

 

 

The opposition is a pillar for political reform and its removal from the equation undermines the whole project

   

 

The second session of the High Administrative Court of Appeal will be held on October 22 to review the response of Waad’s defence team to the memo of the Ministry of Justice, which demanded to dissolve the Society and liquidate its property, based on alleged infringements. The charges,in essence, affect the right to freedom of expression in the political space and the right of Assembly to exercise political action as mentioned in international laws, criteria and basic norms. These alleged allegations do not stand up to the facts about the political positions of our organisation.

 

 

As the hearing of the Court of Appeal is approaching, we reemphasize:

1. Waad Society, being a non-sectarian political organization that pursues peaceful means and renounces violence, was established aftera national reconciliation and consensus expressed in the vote on the National Charter on February 14, 2001. The Charter included covenants regarding establishment of a constitutional monarchy in line with deep-rooted democracies, the establishment of a democratic civil state based on equal citizenship and respect for human rights in accordance with international law, combatting corruption, and criminalizing discrimination. Failure to comply with what has been agreed upon is a breach of the reform process.

 

2. The lawsuit filed by the Ministry of Justice is a case in which charges were fabricated to criminalize Waad and its political positions.Waad’s principles of peaceful and democratic change are professed in its General Program, statute, electoral programs, documents, political alliances and statements. Waad believes that reform is the essence of the political process and therefore it must be respected by all political parties in Bahrain. Every document and statement issued by Waad refutes the Ministry of Justice ‘s lawsuit.

 

3. We consider the trial of "Waad” an outrageous trial of ideas and intentions, which benefits the enemies of reform and political openness. The difficult times facing our country and the rest of Gulf Cooperation Council countries require unified efforts from all segments of society to face regional challenges and threats, as well as economic and social challenges caused by sizeable budget deficits and mounting public debt.

 

4. The presence of political opposition is a necessity for any society seeking reform, peaceful change and development. Progress requires encouraging opposition’s role in monitoring and detecting shortcomings in the government performance, and presenting alternative proposals it deems fit to solve the political, economic and social crises. Any attempt to undermine the opposition’s critical role,besiege or remove it from the political equation, will lead toundermining the entire political and reform process. Refusal to listen to the voices of political and societal components will only aggravate the transparency and accountability deficit.  

 

Our country is in dire need of healing its many wounds and dealing with the crises that are rampant and urgent. We need to mend and strengthen the civil peace and social stability. This demands the freedom of expression and following the path of true democracy.  Considering all this, we call on the Ministry of Justice to reconsider and withdraw its case from the High Administrative Court of Appeal and to defend and protect political action as an important component of the political process in Bahrain.
